Residence permits

Spanish citizenship: timelines, the CCSE and DELE exams, documents

Citizenship is the final stop of the immigration route: an EU passport, the right to vote, no Extranjería for the rest of your life. But nacionalidad by residence is a marathon with its own rules: only the qualifying years count, two exams are required, and even after approval it is easy to lose everything by missing the oath deadline. Here are the requirements, documents and process - without the myths.

Key takeaways
  • The general rule is 10 years of legal continuous residence; 5 years for refugees, 2 years for citizens of Ibero-American countries, 1 year for spouses of Spaniards.
  • Only legal residence counts: tourist stays and study periods do not go towards the total.
  • You need the Instituto Cervantes exams: CCSE (culture and constitution) and DELE from level A2 (language).
  • Filing is online via sede.mjusticia.gob.es; the formal decision deadline is up to 1 year, in practice longer.
  • After approval: the oath within 180 days, then registration and your DNI.

Timelines: who needs 10 years and who needs 1

Citizenship by residence (nacionalidad por residencia) is the most common route. The period depends on your category:

CategoryResidence period
General case (including citizens of Ukraine, Russia and Belarus)10 years
Recognised refugees5 years
Citizens of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea, Portugal, and Sephardic Jews2 years
Spouses of Spanish citizens, people born in Spain, widows and widowers of Spaniards1 year

Important: the period must be continuous and immediately precede the application. Spouses of Spaniards need one year of legal residence while married and living together.

What counts as residence and what does not

The main citizenship trap is miscounting your qualifying period. Only periods of legal residence count towards the 10 (or 2, or 1) years:

  • They count: residence permits based on work, autónomo, family reunification, arraigo, no lucrativa, larga duracion.
  • They do not count: tourist stays, periods without status, the student estancia (it is not residence), and on temporary protection the positions of the administration and the courts diverge - check your specific case.

Continuity is broken by long absences: as a benchmark, single trips longer than 6 months put your period in doubt. A clean record also matters throughout: no convictions in Spain or in your country of origin, plus good civic conduct (buena conducta civica), which is assessed across your entire history.

The CCSE and DELE A2 exams

Citizenship requires two exams run by the Instituto Cervantes:

  • CCSE - a 25-question test on the constitution, the structure of the state and Spanish culture. The pass benchmark is 15 correct answers. Cost - benchmark 85 €, with one resit included in the fee. Sessions run almost every month except August and December.
  • DELE A2 (or higher) - the Spanish language exam: listening, reading, writing and a speaking part. Cost - benchmark 130-160 € depending on the centre.

Exemptions: citizens of Ibero-American countries do not sit the DELE (Spanish is their native language); minors and people with health limitations are exempt from the exams. The certificates never expire for filing purposes - you can sit them in advance without waiting for your full qualifying period.

Tip: sit the exams a year before your qualifying date arrives. This removes the main source of rush and lets you file your application on the very first day.

Documents

The basic filing package (the exact list may be refined):

  • the application and the state fee (tasa 790 code 026, benchmark around 104 €);
  • a full copy of your passport and TIE card (ideally the whole history of your cards);
  • your birth certificate with an apostille and a sworn translation;
  • a criminal record certificate from your country of citizenship with an apostille and translation (valid for a limited period - order it to match your filing date);
  • the certificado de antecedentes penales from Spain (requested by the ministry automatically or attached);
  • volante de empadronamiento historico - proof of continuous residence;
  • the CCSE and DELE certificates;
  • for reduced periods - proof of your category: a marriage certificate with a Spaniard, refugee status and so on.

Filing and waiting for the decision

  1. Auditing your period and dossier. We check that the qualifying period has been counted correctly and that every certificate is still valid by date.
  2. Filing online - via the Ministry of Justice electronic portal (sede.mjusticia.gob.es), in person or through a representative.
  3. The wait. The formal deadline is up to 1 year. In practice files take longer; the status is tracked in your online account.
  4. Silence = refusal. Once a year passes with no answer, silencio negativo applies - this opens the right to a court appeal, which many use to speed things up.
  5. Possible requests. The ministry may ask for additional documents - you must respond within the deadline.

The oath and what comes after

Approval is not the finish line yet. Next:

  • Jura (the oath) - within 180 days of notification: an oath of loyalty to the King and the constitution at the Registro Civil or before a notary. Missing the deadline means losing the granted citizenship.
  • Renouncing your previous citizenship. Most applicants (apart from the privileged categories) make a formal declaration of renunciation. The real consequences depend on your country's legislation - work the question through in advance.
  • Registration and documents. After the oath: entry in the civil registry, then your DNI and Spanish passport.

From that moment you are an EU citizen: freedom of movement and work across the whole Union, consular protection, the right to vote.

Frequently asked questions

The general rule is 10 years of legal and continuous residence. Reduced periods: 5 years for refugees, 2 years for citizens of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea, Portugal and Sephardic Jews, 1 year for spouses of Spaniards and people born in Spain. For citizens of Ukraine, Russia and other CIS countries the general 10-year period applies.

Two Instituto Cervantes exams: CCSE, a test on the constitution and culture of Spain (benchmark 85 €, one resit included in the fee), and DELE at level A2 or higher (benchmark 130-160 €). Native Spanish speakers from Ibero-American countries are exempt from the DELE, and minors are exempt from both exams.

The formal processing deadline is up to 1 year from filing. In practice files often take longer. Administrative silence after a year counts as a refusal (silencio negativo), which opens the way to an appeal - many files speed up precisely through the courts.

At the oath most applicants (apart from citizens of Ibero-American countries and several other groups) make a formal declaration renouncing their previous citizenship. What consequences that declaration has in your country of origin depends on its laws; this question is worth working through in advance.

Within 180 days you must take the oath (jura) - at the Registro Civil or before a notary. After the oath your birth is registered in the Spanish registry and your DNI and Spanish passport are issued. Missing the 180-day deadline leads to losing the granted citizenship.
